    My 15 Year Old Daughter a Citizen Without Rights

    As you already know, I'm not from this state.  If this situation had happened in
    California, I don't think the outcome would have been the same.  This child (in question), was my daughters friend.  The weekend before she was at my house doing my daughters hair.  After spending the night, my daughters realized she like girls.  When she made her advances to my daughter, she was rejected.  This girl got really angry.  She started calling my house threatening to "kick my daughters a__".  I had to get on the phone to tell her to stop calling my house, or I would call the police.  She called one more time and told my daughter when she got off the bus the next day, she would be waiting for her to kick her a__.  This girl was twice my daughters size.  When my daughter got off the bus the next day, sure enough the girl was standing in front of the school waiting for her.   She squared off, my daughter walked around her and told her she did'nt want to fight her.  Well, the girl got right in my daughters face and said B---H, I'm fixen to kick your a--.  My daughter told her again, I don't want to fight you. (I think my child was a afraid because the girl was a lot bigger than her).  How many times do you walk away from a fight to be justifide 1, 2 or 3.  Well, she got a little to close, so my daughter hit her and the fight was on.  The girl pulled some of my daughters hair out,  she had a knot on the side of her head.  When I got to the school, my child was arrested for disorderly conduct.  I tryed to explain the incident to the resourse officer, he did'nt want to here it. It seems to me they were more concerned about arresting my child no matter what the circumstances were. When I got in court, the Public Defender tells my daughter to plead guilty against my wishes.  I had some choice words for her.  She convinced my daughter,that it would be a waist of time coming in and out of court on this issue.  Thats my hold point.  So why were we there?  I'll anwser that, So the courts can give my daughter community service to pick up trash out of the street, when she could be home studing.  (free labor) I feel my daughter was in a self defense mode, and this was not fair.  It seems to me, here in this state the kids, children are being arrested for all sorts of issues that should have never made it to court.  Did you no, once these children are arrested, they can be held without bail for up to one year? Come on now.  My other daughter, when she was 11 was arrested for some of the same issues. I plead her not guilty.  Even thought I pled her not guilty,  she still was put on probation, curfew etc.   End result was all charges were dropped.  Is this fair.  Plead guilty your punished, plead not guilty your punished.

    I tottally understand where you are coming from but the problem is your daughter throwed the first lick.My kids have come home telling me that some kid was going to jump them when they see them and I always tell them you fight you get suspended and then you get in trouble at home but if the other person throws the first lick then you should defend yourself and I will defend you till the end.

    Tell her not to let people provoke her with words are looks wait and react when its time.My neice last year was suspended from school for fighting but she waited untill she was hit so I defended her to her dad .If the other girl had hit her first instead of your daughter you could have been in the other parents shoes and she would be pleaing her case in court..So no it's not fair just the way the law sees things
